1. About these terms
These terms apply when you use the Rollup iPhone app or website (“Rollup”). Rollup is run by [TODO: company legal name], a company registered in England and Wales (company number [TODO: Companies House number]), registered office [TODO: registered office address] (“we”, “us”).
By using Rollup you agree to these terms. If you don’t agree, please don’t use it. Our Privacy policy explains how we handle personal data. If you’re a consumer, nothing in these terms affects your legal rights.
2. What Rollup is
Rollup is a free guide to Pilates studios in London. It shows where studios are, the class types they offer and, where the studio publishes them, prices and intro offers, with links to the studio’s own website and booking page. It also lets you join an optional founding-member list (or, if you teach Pilates, a founding-instructor list) for a future version of Rollup with in-app booking.
Rollup is independent. Unless a listing says otherwise, we’re not owned by, endorsed by or in partnership with the studios we list, and listing a studio isn’t a recommendation.
3. Studio information
- We collect studio details from public sources, mainly each studio’s own website, and show the date we last checked them. They’re provided for general information, “as is”.
- Prices, offers, class types and other details can change at any time and may be out of date or incomplete. Always confirm with the studio before you book or travel.
- Locations on the map are approximate. Use the studio’s address and directions to find it.
- “Every studio” is our aim, not a promise: we may not have every studio yet. Missing or wrong details can be reported to us, and studios can ask to update or remove their listing at any time on our studios page.
4. Booking with studios
In this version of Rollup, you can’t book or pay for classes in the app. When you tap “Book on studio’s site”, you go to the studio’s own website or booking system. Any booking, payment, pack, membership, cancellation or refund is a contract between you and the studio, on the studio’s terms. We’re not a party to it and we don’t receive your payment. Please raise any problems with a class or booking with the studio directly.
If we add booking to Rollup in future, we’ll publish separate terms for it, and you’ll be asked to accept them before you book.
5. Your health
Pilates is physical exercise. Rollup doesn’t give medical, fitness or health advice, and class-type labels (such as “clinical” or “prenatal”) are the studio’s own descriptions. If you’re pregnant, injured, have a medical condition or are new to exercise, check with a doctor or qualified professional, and tell the studio before your class. Studios are responsible for the classes they run.
6. Founding members and founding instructors
- Joining is free and doesn’t commit you to anything. You must be 16 or over and give your own, accurate details.
- Founding members get first access to booking in Rollup in their area when it launches, and launch perks. We’ll confirm what the perks are, and any conditions, before booking opens. Perks aren’t transferable and have no cash value.
- We may invite people in stages (for example by area, or earlier for people who referred friends). We’re building towards a launch, but we can’t guarantee when, or whether, booking will launch in a particular area.
- Your referral link is for sharing with people you know. Don’t spam it, post it where that isn’t allowed, or create fake sign-ups. We may ignore referrals or remove sign-ups that break these terms.
- You can leave at any time by deleting your sign-up (see our Privacy policy). We may close or change the founding-member programme, and we’ll tell members by email if we do.
- Founding instructors. If you teach Pilates, you can join our founding-instructor list. It’s free and doesn’t commit you, or us, to anything. Your founding instructor number shows the order people joined; it isn’t a ranking. Founding Instructor perks will be announced later, and we’ll confirm what they are, and any conditions, before they apply.
- Founding instructors get an invite link to share with their clients. Clients who join the founding members with it are counted for that instructor, and get founding points like any other member. The same rules on sharing apply: no spam, and no fake sign-ups.
7. Founding member points
Founding members collect points before booking opens in Rollup, to use as money off classes once it does.
How you earn points
- 100 points for joining the founding members.
- +50 points for each friend who joins the founding members with your link, using their own email address. You can earn this for up to 40 friends (2,000 points). Friends who join after that are still welcome, and still count towards getting in first, but don’t add points.
- +200 points for getting the app, once per member. It’s automatic if you join in the app. If you joined on the website, add your bonus in the app with the email you joined with.
What they’re worth
- At launch, 500 points = £5 off classes booked and paid for in Rollup.
- Points have no cash value. They can’t be exchanged for cash, sold or transferred to someone else, and they can’t be used with studios outside Rollup.
How points apply at launch
When booking opens, we’ll credit your points to the Rollup account you create with the email you joined with. Before then, we’ll tell you exactly how to use them, including any limit on how many points can go towards one booking.
Fair play
- Points are for real people joining with their own details. Fake, duplicate or automated sign-ups, and signing yourself up again with other email addresses, don’t earn points.
- We may remove points, and the sign-ups behind them, where we reasonably believe these terms have been broken. If you think we’ve got it wrong, email us and we’ll look again.
- If you delete your sign-up, your points are deleted with it.
Changes
We may change or end the points scheme, for example how many points you earn or what they’re worth. We’ll tell founding members by email before a change takes effect. Founding instructors don’t earn points.
8. Acceptable use
Please don’t:
- break the law or anyone’s rights using Rollup;
- send false information, impersonate a studio or another person, or submit requests about a studio you don’t represent;
- scrape, copy or extract the studio directory in bulk, or use automated tools to access Rollup (other than normal search-engine indexing of our website);
- try to break, overload or get around the security of Rollup or its systems, or reverse-engineer the app except where the law allows;
- upload viruses or harmful code.
9. Intellectual property
The Rollup name, logo, app design, illustrations, text and the way we’ve compiled the directory belong to us or our licensors. You may use Rollup for your own personal, non-commercial use. You may not copy, sell or republish it without our written permission.
Studio names and trademarks belong to their owners and are used only to identify the studios. We don’t use studios’ logos or photos. Postcode locations come from postcodes.io and contain OS data © Crown copyright and database right, Royal Mail data © Royal Mail copyright and database right, and National Statistics data © Crown copyright and database right.
If you think something in Rollup infringes your rights, email us and we’ll look into it promptly.
10. Other websites
Rollup links to studios’ websites, Instagram, Apple Maps and other services we don’t control. We’re not responsible for their content, availability, terms or privacy practices.
11. Availability and changes
Rollup is free and provided as it is. We’ll try to keep it running and accurate, but we don’t promise it will always be available, error-free or up to date. We may change, suspend or withdraw any part of it. We may update these terms; the “Last updated” date will change, and if the change matters we’ll tell you in the app or by email (if you’re a founding member). Using Rollup after a change means you accept the new terms.
12. Our liability to you
- Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law doesn’t allow us to limit or exclude, including your statutory rights as a consumer.
- We provide Rollup for domestic and private use. We’re not liable to you for any loss of profit, business or opportunity.
- We’re responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We’re not responsible for loss or damage that isn’t foreseeable.
- We’re not responsible for classes, bookings, payments, cancellations, injuries or anything else arising from your dealings with a studio, or from relying on studio information without checking it with the studio, except where caused by our own negligence or breach of these terms.
- Because Rollup is free, and to the extent the law allows, our total liability to you for any claim about Rollup is limited to £100.
- If digital content we supply damages a device or other digital content you own because we failed to use reasonable care and skill, we’ll either repair the damage or pay you compensation.
13. Apple App Store terms
If you downloaded the app from Apple’s App Store, these terms are between you and us, not Apple. Apple’s Licensed Application End User License Agreement (the “Standard EULA”) also applies to your use of the app, and these terms add to it. In addition:
- We, not Apple, are solely responsible for the app and its content.
- Apple has no obligation to provide maintenance or support for the app. Contact us for support.
- To the extent the law allows, Apple has no warranty obligation for the app. If the app fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any; the app is free).
- We, not Apple, are responsible for handling any claims relating to the app or your use of it, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection, privacy or similar claims.
- We, not Apple, are responsible for investigating, defending, settling and discharging any claim that the app infringes someone’s intellectual property rights.
- You confirm that you’re not located in a country subject to a UK or US government embargo, and that you’re not on any UK or US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, Apple has the right to enforce them against you.
14. Law and disputes
These terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales. If you live in Scotland, you can also bring proceedings in Scotland; if you live in Northern Ireland, you can also bring proceedings in Northern Ireland. If there’s a problem, please contact us first and we’ll do our best to resolve it.
If a court finds part of these terms unenforceable, the rest still applies. If we don’t enforce a right straight away, we can still enforce it later.
